A factual investigation is the process undertaken to collect evidence following an event as well as establishing the time, date and place.
Evidence may include, taking witness statements, taking photographs, obtaining CCTV, identifying and obtaining supporting documents and records, applying for Police reports, obtaining Court records, business records, and ownership statements.
It may also include locating further witnesses, identifying further avenues of inquiry, and engaging forensic experts to undertake specialist examination of evidence collected.
A proper factual investigation should collect evidence to establish the facts surrounding an event and should not place any bias on findings. Evidence must be collected in a thorough and timely manner and not deliberately include or omit any information to support one party’s position or allegation.
The collection of evidence in an admissible manner is crucial as it may be relied upon in Court proceedings or a Tribunal. An investigation should be conducted as soon as possible after the event so as to best preserve physical evidence, digital evidence and witness observations.

A factual investigation is often used in insurance matters where the veracity of the claim is not clear or fraud is suspected. In these circumstances conducting the investigations as soon as possible has the benefit of limiting the loss of evidence.
